A Dubai Civil Court has ordered a driver to pay Dhs160,000 in compensation to a British man who sustained severe injuries after being struck by a vehicle in an Al Quoz parking lot last August. The victim was standing behind his own car when the Asian driver hit him, resulting in multiple fractures to his left forearm and foot, a fractured forehead, and various abrasions and bruises.
The legal proceedings began in the Dubai Misdemeanors Court, which initially fined the driver Dhs5,000 and suspended his driving licence for three months. After the criminal conviction was upheld on appeal, the victim initiated a civil lawsuit seeking Dhs1.295 million in damages. His claim included Dhs31,976 for medical expenses, Dhs240,000 in lost wages, Dhs524,000 for lost business profits, and Dhs500,000 for moral and material damages.
Medical records presented to the court detailed that the victim required surgery to stabilize his fractures the day after the incident and underwent months of follow-up care. Although the fractures eventually healed, the man reported persistent pain, swelling, and a restricted range of motion in his left wrist. The Public Prosecution had previously charged the driver with negligence, failure to follow traffic regulations, and property damage.
In its ruling, the civil court emphasized that the final criminal judgment established the driver’s liability, a fact that could not be revisited. While the court accepted documentation verifying Dhs31,975 in medical treatment costs, it rejected the claims regarding lost wages and business profits, citing insufficient evidence and an inadequate expert report.
Ultimately, the court determined that the compensation of Dhs160,000 was appropriate to cover the physical injuries, psychological trauma, and moral damages sustained by the plaintiff. The ruling also mandates that the defendant cover all associated legal fees and expenses, while dismissing the remainder of the victim’s financial claims.
